Kidnapping or abducting in order to murder
IPC 364 (Kidnapping for Murder) — kidnapping or abducting in order to murder — now maps to BNS Section 140(1). Key change: No major change. Punishment under BNS 140(1): Same - Life or 10 years.
The Bharatiya Nyaya Sanhita (BNS) 2023, in force since 1 July 2024, has replaced the colonial-era Indian Penal Code (IPC) 1860. IPC 364 deals with kidnapping for murder, part of the IPC's offences affecting the human body — homicide, hurt, wrongful restraint, criminal force, kidnapping and sexual offences, the largest group in the code. The BNS renumbers kidnapping for murder as BNS 140(1) and, for several sexual and grievous-hurt offences, enhances the punishment.
IPC 364 dealt with kidnapping for murder — kidnapping or abducting in order to murder. Until 30 June 2024, every FIR and criminal trial for this offence was registered and prosecuted under this provision of the Indian Penal Code 1860.
No major change. From 1 July 2024, new complaints relating to kidnapping for murder are filed under BNS Section 140(1), while cases registered earlier continue under the old IPC provision as per the saving clause of the BNS.

No. The Indian Penal Code 1860 was repealed and replaced by the Bharatiya Nyaya Sanhita (BNS) 2023 on 1 July 2024. The kidnapping for murder offence earlier in IPC 364 is now governed by BNS 140(1) — pending IPC 364 cases continue, but new FIRs cite BNS 140(1).
