IPC 392 (now BNS 309): Punishment for Robbery

IPC Section 392 prescribes the punishment for robbery. Robbery is theft or extortion committed with the use of, or threat of, force or instant hurt. From 1 July 2024 the punishment provision continues as Section 309 of the Bharatiya Nyaya Sanhita (BNS) 2023.

Punishment under BNS 309 (same core as IPC 392)

  • Robbery: rigorous imprisonment up to 10 years, and fine.
  • Robbery on a highway between sunset and sunrise: the maximum may extend to 14 years.

What changed from IPC to BNS?

The substance is the same — only the section number moved (IPC 392 → BNS 309). The BNS arranges the robbery and dacoity provisions in a clearer sequence, but the punishment for ordinary robbery is unchanged. New FIRs cite BNS 309.

Practical notes

  • Advocates: distinguish robbery (BNS 309) from plain theft and extortion — the presence of force or fear of instant hurt is the deciding ingredient.
  • Robbery is a serious, cognizable offence — consult a criminal lawyer immediately for bail and defence.
